These are the terms and conditions for the domain www.phkeducation.com and the course title Exam Success Formula. By purchasing any products or services you agree to these terms and conditions. Terms and Conditions may change from time to time

You/Your The client/member, responsible for payment of products and services.

The copyright of all resources, branding and website graphics, except where otherwise stated, are the property of Priya Kara. In line with Copyright, Designs and Patents Act, 1988, Priya Kara must be identified as the author of this work. All rights are reserved by the author, Priya Kara.

You may not:

Share or reproduce purchased electronic resources.

Download, reproduce, transmit, use, or incorporate any of the PHK Education branding, photographs, website text, files or videos without the prior written consent of Priya Kara

Purchases or Downloading of My Study Planner

Purchasing ‘My Study Planner’ are for personal use only, the planner cannot be shared with anyone else in any capacity, including (but not limited to) printing or photocopying, sharing the digital resource file, sharing a photograph of the resource that is of high enough quality for production.

You may not use or incorporate any of the original images, files, pictures, videos, text, or diagrams from the resources in your own original work or to publish, distribute, display, or pass off as your work.

You may not remove the Copyright logo (phkeducation.com) from any Resource.

The My Study Planner is available for purchase in the UK only.

Membership & Payments for the Course: Exam Success Formula

Payments are made once a month, via direct debit, from the date that you enrol.  Upon payment, you confirm your continued membership.

1.     Membership lengths are available for a minimum term of 1 month.  If you are on a discounted fee, this will apply for as long as you have uninterrupted membership.  If you cancel and re-join at a later date, you will be required to pay the current fee advertised at that time.

2.     If you fall behind with membership fees and this is not caused by a bank error, we may charge reasonable administration fees or suspend or cancel your membership. 

3.     We may decide to increase our membership fees, but your fees will not increase for as long as you have uninterrupted membership.  If, for unforeseen circumstances, your membership fees do increase, you will be given a minimum of 14 days’ notice.

 We use Thinkific payment processes to process payments you made by authorised and valid credit or debit cards. We don’t collect your card data.

 Without payment, a purchase will not be complete and you will not have secured access to the Service until you received a confirmation email. Upon receiving successful notification, we will provide access details by email.

 If you provide credit card information to pay for fees, you hereby represent and warrant that you are authorised to supply such information.

Refunds and Your right to cancel for the course: Exam Success Formula

You can cancel your membership of the course at anytime. Your membership will not renew at the next arranged date and no further monies will be debited from your account/card.

 If you cancel your membership during a month you have already paid for, any monies paid thus far will not be refundable or transferable. 

 No refunds or monies will be given or transferred if You decide that the Service is not suitable for your needs. It is Your responsibility to carry out due diligence before completing your purchase, for example booking a Free Discovery Call or emailing beforehand. It is advised that you ask any questions regarding the Course. You must have permission from the bill payer and by ticking the terms and conditions you are confirming that you do.

 You will not be entitled to bring any claim or legal proceedings in respect of any refund or repayment, howsoever arising, 3 months after the date on which entitlement to such a refund or repayment arose. 

 We will not be responsible for any breach of these Terms caused by circumstances beyond Our reasonable control.  This includes responsibility for third party software and applications.

 The Terms shall be governed by English law and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

Suspension of services

Your Account may be suspended if you breach any stated terms. If your account is suspended, monies paid are not refundable or transferable.

 Situations that may lead to the suspension of services with immediate effect:

 •  Payment has not been received 

•  Attempts to share membership/Account details with other non-paying persons 

•  Gross misconduct e.g. threatening behaviour from a member or anyone associated with the member, attempts to recruit members

•  Conflict of interest with the Service/Product subscribed to

•  Any breach of these Terms and Conditions

•  Force majeure

 If we suspend your Account or access to the Services for any reason, we can legally refuse to provide you with any Services or the right to purchase further Services. 

​​Thinkific Platform Use

Accounts may only be used by the individuals named on the Account and those names must be real and accurate.

 Priya Kara will endeavour to maintain the availability of the Platform to You, but does not guarantee 100% availability.  For instance, if the supplier, Thinkific Labs Inc. face technical issues or the internet connection is faulty.

 All users of the Platform must:

 (a)  be appropriate with generally accepted standards of etiquette and behaviour 

(b)  not engage in activities that are unlawful, fraudulent, harmful or in connection with any such activity

(c)   not attempt to reproduce, copy, modify, publish, exploit or distribute any material in any way 

(d)  to conduct any systematic or automated data collection activity, via or in relation to the platform

(e)  to conduct (or request that any other person or entity conduct) any load testing or penetration testing

(f)  in any way (or promote the Platform in any way) which is liable to result in the blacklisting of any IP addresses or domains being used by the platform

 If any of the terms are breeched your account may be closed.

Parental/Legal Permission

Any student/s under the age of 18 must have parental/legal guardian’s permission before signing up for the online course, Exam Success Formula or 1:1 coaching.

 1:1 coaching

By signing up to 1:1 coaching You agree to the following terms and conditions.

Any student/s under the age of 18 requesting a coaching service must have parental or a legal guardian’s permission to do so.

By purchasing 1:1 coaching session You can choose your package of either 3 or 6 coaching sessions. You can reschedule your coaching session up to 12 hours prior. Beyond this time no refunds or sessions can be rescheduled unless at the discretion of Priya Kara.

Discounted 1:1 is available only of You purchase the full Exam Success Formula Course

We are not responsible for any grade received by a student or any consequence that examination grades entails.

 Online Monthly Masterclasses

This service is available if You purchase the full monthly online course package.

 By joining the monthly Live Masterclass you agree to the following:

 Kind and courteous behaviour

During the group sessions bullying will not be tolerated in group coaching sessions and is likely to lead to the immediate removal of a student from the session.

If you are unable to join the live session, you can access to the recorded session on the platform.

 Your Data

We take handling your data very seriously.  Please view the Privacy Policy for more details on how we use your data.

Promotional materials

There may be some use of photographs, video or digital images from on the online montly coaching sessions for social media and marketing purposes. Every effort will ensure and make students aware if/when this happens so that they can opt out. If You object, please put this in writing beforehand.

Changes to the terms and conditions

 We reserve the right, at our sole discretion, to update, change, amend or replace any part of the Terms and Conditions by posting updates and changes to our website.

Every effort will be made to notify you of changes but you are encouraged to check these terms if you are in any doubt.

  

Terms and Conditions (Geography Tuition) 

 At PHK Education, we aim to have complete clarity when you as a client; or when your student/learner engages in Geography tutoring lessons with us. This is set out in the Terms and Conditions in this policy. Note: PHK Education (Priya Kara) reserves the right to make changes to these terms and conditions; which will be found on this website.  

Contracts and Personal Information

Clients must read and sign a contract during the first lesson. This contains details of your payment plan and how payment will be made. It will also set out guidelines about expectations regarding behaviour, conduct and homework.

Invoices/Payment/Charges

  • Lessons are charged as per the rates discussed at the time of the discovery call. Note: All fees are set and are not open to negotiation.

  • All payments for lessons must be made in full at least 48 hours before each first lesson.

  • Lessons are to be paid in four-week block and should be paid at least 48 hours before the lesson commences.

  • Clients will be invoiced and the tutor will then inform the client that the payment receipt has gone through. 

  • Payment for the lessons should be done via bank transfer, details on how to do this is provided on the invoices sent to you. Note: We do not take cash for any transactions whatsoever.

Cancellations

  • Cancelled/missed sessions are non-refundable. It is not possible to 'roll-over' the lesson to any subsequent weeks and no refund will be given for any missed/cancelled lessons. If a student is unwell and cannot attend tutoring lessons; it is at the discretion of the tutor; (Priya Kara), as to whether the charge for this lesson will stand. It is up to the client/parent to inform the tutor as to when their learner is able to resume tutoring lessons. 

  • On the rare occurrence that lessons are cancelled by me, I will reschedule the lesson to take place on a different time/or day.

  • If you wish to completely cancel your tuition contract and lessons, the client must give at least 5 DAYS NOTICE in writing or email. Note: If you cancel before the end of a block of lessons; you will not be refunded any remaining weeks left.  

Timekeeping and parental involvement

  • All lessons are 1 hour in duration; regardless of whether they are online or face-to-face.

  • It is important that all lessons start on time. If a student is 10mins late (or more and without reason) to attend a lesson; whether online or face to face, the tutor (Priya Kara) reserves the right to cancel the lesson. If a student is consistently late for their lesson; there is a possibility that the contract will be terminated. It is up to the client/parent to inform the tutor prior to the lesson if their learner is going to be late for a lesson. 

Online lessons and Google Classroom

·       All online work and homework is shared between the tutor, student and client/parent via Google Classroom or  Google Drive. The ‘classroom’ is exclusive only to these people and should not be shared with any other parties. (To avoid Data Protection issues). 

·       If there are connection issues, the student/child/learner should use the ‘chat facility’ on Zoom to notify the tutor by typing to them that there is a problem; or they should inform the client/parent as soon as possible to try and rectify the issue.

·       The client/parent/student should communicate via telephone if the connection is completely lost as soon as possible. 

·       If connection issues continue for longer than 15 minutes (whether that is on the tutor’s internet connection or with the student's or client's connection); the tutor reserves the right to end the lesson and then reschedule it at another time mutual to both the tutor and the parent/client/student.

Homework 

·       In order for the student to progress, it is sometimes necessary that a short amount of homework or extra work is set. If the client/parent does not wish the student to have any extra work such as this; they need to communicate this to the tutor. (Priya Kara). 

·        It is important that the student completes the homework in readiness for the next lesson. All homework/extra work is marked and feedback is given. Whether it is homework for online or face-to-face lessons, I always aim to mark and send back work before the next lesson. 

 

Communication:

The tutor and the client can communicate together via emails, text messages, WhatsApp and other communication channels.

Clients will be added to email list (upon permission during the discovery call) for information regarding the Exam Success Formula Study Hub.  

FEEDBACK:

Short feedback can be written up at the end of the session on a shared google document. However, if you would like to request further time please let Priya know as soon as possible in advance and be present a few minutes before the lesson ends. This allows planning the lesson with a few minutes in mind for the chat before the lesson ends so it wouldn’t affect the next scheduled lessons.
